TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of Sky Oceans: Wings for Hire (the "Game"), developed and published by OCTETO STUDIOS SPA ("Octeto Studios," "we," "our," or "us").

By downloading, installing, accessing, or playing the Game, you agree to be bound by these Terms. If you do not agree with these Terms, do not install or use the Game.

1. Eligibility

You must be legally capable of entering into a binding agreement under the laws of your jurisdiction. If you are under the age of majority, you may only use the Game with the permission of a parent or legal guardian.

2. License

Subject to these Terms, Octeto Studios grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Game solely for your personal, non-commercial entertainment.

This license does not transfer ownership of the Game or any intellectual property rights.

3. Ownership

The Game, including all software, artwork, music, sound effects, dialogue, text, characters, animations, trademarks, logos, and other content, is owned by Octeto Studios and/or its licensors and is protected by applicable intellectual property laws.

All rights not expressly granted are reserved.

4. Restrictions

You agree not to:

  • copy, distribute, sell, rent, lease, sublicense, or commercially exploit the Game;

  • modify, adapt, translate, or create derivative works based on the Game;

  • reverse engineer, decompile, or disassemble the Game except where expressly permitted by applicable law;

  • remove or alter copyright, trademark, or proprietary notices;

  • use the Game in any unlawful manner;

  • interfere with platform services or security features.

5. Platform Services

The Game may be distributed through third-party platforms including Steam, PlayStation, Xbox, Nintendo Switch, and Google Play.

Your purchase and use of those platform services are also governed by the applicable terms and policies of the respective platform providers.

Octeto Studios is not responsible for the operation, availability, payment processing, or account management of these third-party services.

6. Google Play Games Services

The Android version of the Game may integrate Google Play Games Services, including achievements, cloud save functionality, and player authentication.

Your use of these features is governed by Google's applicable terms and privacy policies.

7. Updates

Octeto Studios may release patches, updates, bug fixes, performance improvements, balance adjustments, or compatibility updates at any time.

Certain updates may be required for continued compatibility with supported devices or platforms.

We are under no obligation to continue supporting any particular version of the Game indefinitely.

8. Privacy

The Game does not require users to create an Octeto Studios account and does not intentionally collect personally identifiable information directly.

The Game may transmit anonymous technical and gameplay information for purposes such as:

  • application stability;

  • crash diagnostics;

  • performance monitoring;

  • gameplay analytics.

The Android version may also interact with Google Play Games Services when enabled by the player.

9. Third-Party Software

The Game incorporates third-party technologies and software components licensed to Octeto Studios.

Your use of those components is subject to any applicable third-party licenses where required.

10. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Game is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory.

Octeto Studios does not warrant that:

  • the Game will operate uninterrupted;

  • the Game will be error-free;

  • defects will always be corrected;

  • the Game will be compatible with every hardware configuration or software environment.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the above limitations apply only to the extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, Octeto Studios, its directors, employees, licensors, partners, and affiliates shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to your use of the Game.

Where liability cannot be excluded under applicable law, our liability shall be limited to the maximum extent permitted by law.

12. Termination

These Terms remain effective until terminated.

Your rights under these Terms automatically terminate if you fail to comply with any provision.

Upon termination, you must cease using the Game and destroy all copies in your possession where required by law.

13. Export Compliance

You agree to comply with all applicable export control and economic sanctions laws governing the distribution and use of the Game.

14. Changes to These Terms

We may modify these Terms from time to time.

The revised version will become effective upon publication together with its updated Effective Date.

Your continued use of the Game after any changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Chile, without regard to conflict of law principles.

Any dispute arising from these Terms or the Game shall be submitted to the competent courts of Santiago, Chile, unless applicable consumer protection laws provide otherwise.
